U.S. District Court Delays

The U.S. District Court for Montana has ordered that a July 27 hearing regarding R-CALF's suit against the USDA's minimal risk region rule be delayed until the court provides further instruction.

On July 14, a three-judge panel with the 9th U.S. Circuit Court of Appeals issued an order allowing USDA to implement the rule, resulting in Monday's reopening of the U.S. border to Canadian cattle.

"In that order, the judges said they would issue their opinion on the order 'expeditiously,' but they have not yet taken that action, so we still don't know why the panel reversed the preliminary injunction R-CALF was granted in March [by U.S. District Court Judge Richard Cebull]," said R-CALF CEO Bill Bullard.

Bullard speculated that because the 9th Circuit has yet to issue an opinion, Cebull may have believed it was appropriate to delay the hearing until he had time to review the opinion.

"R-CALF looks forward to the written opinion of the 9th Circuit and is prepared to present its case to the court soon after the opinion is issued," Bullard said.
